With the aim of strengthening the protection of children and adolescents, an initiative was presented in Mexico City that proposes that the most severe form of animal abuse be considered a cause for the loss of parental authority. The proposal by the MC party deputy, Luisa Alpízar, seeks to address a deep-rooted problem: violence does not arise in isolation, but is learned, normalized, and reproduced within family environments, often beginning with the most vulnerable beings, such as animals. What does the initiative propose? The initiative proposes to modify article 444 of the Civil Code for Mexico City, so that judges can determine the loss of parental authority when a person has been convicted of serious acts of abuse or cruelty to animals. This is not an automatic measure. For it to proceed, three conditions must be met: it must be a serious crime, not a minor offense; there must be a firm conviction; a judge must evaluate the specific case, prioritizing the well-being of children. This means that not any conduct related to animals will be a reason for this sanction, but only those that reflect extreme violence. Prison for animal abuse One of the foundations of the initiative is article 350 Ter of the Penal Code of Mexico City, which sanctions animal abuse or cruelty in its most severe form. This article contemplates: prison sentences for causing the death of an animal willfully; harsher penalties when there is extreme or prolonged suffering. The initiative adopts these criteria to identify behaviors that can represent a real risk within the family environment. Why link animal abuse with childhood? Various studies on family violence have shown that animal abuse can be an early warning sign of broader violent behaviors. Among its implications are: normalization of suffering; use of violence as a form of control; emotional impacts on children and adolescents; possible precursor to family violence. Therefore, the proposal bets on a preventive approach, acting before the damage directly affects minors. New family dynamics The initiative also recognizes that nowadays, companion animals are part of the emotional core of many families. Their well-being directly impacts the emotional development of children and adolescents, so violence against them affects the entire family environment. A preventive, not punitive measure The loss of parental authority is an exceptional measure that seeks to protect minors when their well-being is at risk. In this case, it is proposed that acts of extreme violence against animals can be sufficient grounds for a judge to evaluate whether a person has the necessary conditions to exercise parental responsibilities. A clear message against violence The initiative sends a powerful message: violence is not tolerable in any of its forms; parental authority implies responsibility, not privilege; childhoods must grow in safe and violence-free environments. The proposal seeks to strengthen the comprehensive child protection system in Mexico City through a preventive vision that addresses the roots of violence. The objective is to move towards a more empathetic society, where respect for life and care for the most vulnerable are fundamental pillars within families. The proposal establishes that each case must be analyzed individually, under strict criteria and always prioritizing the best interests of the child. The objective is to prevent risks and avoid that minors grow up in environments where violence is already present.
